Nichia has filed a lawsuit in Germany against Everlight, seeking 2.5 million EUR in damage compensation for alleged patent infringement.

Nichia Corporation, a Japanese LED manufacturer, has filed a lawsuit at the Düsseldorf District Court against Taiwanese company Everlight Electronics Co., Ltd. and its German subsidiary Everlight Electronics Europe GmbH. The lawsuit, initiated on March 12, 2025, claims damage compensation for patent infringement based on two final judgments of the Düsseldorf District Court.

The judgments in question pertain to Nichia’s YAG patent EP 936 682 (DE 697 02 929). In the first judgment (docket number 4b O 56/12), the court ruled in favor of Nichia, finding Everlight guilty of infringing on Nichia’s patent. In the second judgment (docket number 4b O 161/17), Everlight acknowledged all claims made by Nichia, resulting in the court confirming these claims in favor of Nichia.

However, Everlight initially argued that the scope of the damage compensation should only apply to the specific products mentioned in the judgment. They also refused to provide account information for other products. In response, Nichia initiated enforcement proceedings, which led to the court confirming Nichia’s legal view. As a result, Everlight was obligated to provide complete account information.

Based on this information, Nichia believes that a reasonable damage award should amount to 2.5 million EUR and has now filed court proceedings to claim this compensation. The amount is calculated based on the account information provided by Everlight.
